Terms of Service for Color Lens

These Terms of Service ("Terms") govern your access to and use of the Color Lens Shop Mini application (the "App"), provided by Not A Side Project ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

1. Description of the App

Color Lens is a utility application designed to help users find shopping results by allowing them to search for products using custom keywords within the host e-commerce platform.

2. Reliance on Host Platform (Shopify)

The App operates as a "Shop Mini app" hosted entirely within the Shopify platform (the "Host Platform").

  • Purchases & Transactions: All product listings, purchases, payments, shipping, and customer service are handled exclusively by the Shopify platform and the merchants on that platform. Color Lens is only a search interface tool and is not responsible for any transaction, product quality, delivery, or disputes.

  • Host Terms: Your use of the App is also subject to Shopify's terms of service and policies.

3. Data Storage

The App stores your last six (6) custom search keywords locally on your device for your convenience only. This data is not Personal Information, is not transmitted to us, and is governed by our separate Privacy Policy.

4. Intellectual Property Rights

  • App Content: The App, its features, code, design, and all related content (excluding product listings provided by the Host Platform) are the property of Not A Side Project and are protected by intellectual property laws.

  • Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use, subject to these Terms.

5. Acceptable Use Policy

You agree not to use the App to:

  • Engage in any illegal or unauthorized purpose.

  • Interfere with or disrupt the functionality of the App or the Host Platform.

  • Attempt to gain unauthorized access to any systems or networks associated with the App or the Host Platform.

  • Use the search function to harass, abuse, or defame others, or for any malicious purpose.

6. Disclaimers

THE APP IS PROVIDED "AS IS." We make no warranties, express or implied, regarding the accuracy, completeness, or performance of the App.

  • Search Results: The search results provided by the App are based on the data available via the Host Platform's search API. We do not guarantee the accuracy, relevance, or availability of any specific product or search result.

  • Functionality: While we strive for reliability, we do not warrant that the App will be uninterrupted, secure, or free from errors.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Not A Side Project be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • (i) your use of or inability to use the App;

  • (ii) any conduct or content of any third party on the App;

  • (iii) any products or transactions conducted via the Host Platform.

8. Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by updating the "Last Updated" date at the top of these Terms. By continuing to access or use the App after any such revision becomes effective, you agree to be bound by the revised Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Hong Kong SAR, without regard to its conflict of law provisions.
